Welcome to Ethinova, an AI-powered platform designed to generate high-quality code through advanced AI-driven prompt engineering. By accessing or using Ethinova, you agree to these Terms of Service ("ToS"). Please read them carefully before using our services.

1. Acceptance of Terms

By using Ethinova (the "Service" or "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy. If you do not agree to these terms, please do not use Ethinova.

2. Description of Service

Ethinova provides an AI-powered software tool that allows users to input prompts, and our backend AI generates corresponding code. Our services include, but are not limited to:

  • AI-assisted coding suggestions
  • Intelligent code generation from prompts
  • Software development assistance tools
  • Code debugging and enhancement support

3. Ownership & Licensing

3.1 Proprietary Rights

All original software, AI models, algorithms, and generated content developed by Ethinova are proprietary and solely owned by Ethinova. While users are granted a license to use the platform as intended, they do not gain ownership of AI-generated code unless explicitly permitted.

3.2 Open-Source Components

Ethinova may integrate open-source software licensed under the MIT License or other open-source frameworks. Notable inclusions are:

  • Modifications and enhancements based on publicly available repositories
  • Open-source dependencies as documented in our Legal Notices Section

As per the terms of the MIT License, all original copyright notices of third-party components are retained. However, all proprietary modifications, enhancements, and additional functionalities introduced by Ethinova remain the exclusive property of Ethinova and are not considered open-source.

4. User Responsibilities

By using Ethinova, you agree to:

  • Use the platform only for lawful purposes
  • Not attempt to reverse-engineer, decompile, or redistribute any proprietary parts of the platform
  • Not engage in any form of unauthorized access, exploitation, or data scraping
  • Not use Ethinova for malicious, unethical, or illegal activities, including but not limited to hacking, fraud, or misinformation
  • Take full responsibility for reviewing and testing AI-generated code before deploying it in production environments

5. AI-Generated Code and Liability

  • The AI-generated code is provided "as-is", and Ethinova makes no guarantees regarding its accuracy, security, or performance.
  • Ethinova is not liable for any damages that may arise from the use of AI-generated code.
  • Users must review, test, and validate all AI-generated code before incorporating it into commercial or production-grade applications.

6. Payment & Subscription (If Applicable)

If Ethinova offers paid plans or subscriptions:

  • Fees are non-refundable, except where required by law.
  • Users are responsible for managing their subscription and payment methods.
  • Ethinova reserves the right to suspend or terminate accounts for unpaid services.
  • Subscription plans and pricing details are available on our pricing page.

7. Data Collection & Privacy

Ethinova collects and processes user interactions, code generation patterns, and system usage metrics to improve our platform. Our Privacy Policy details how data is handled, including:

  • Aggregated insights to enhance AI performance
  • Secure storage and encryption measures
  • As of now, we do not comply with industry-standard privacy laws and are not HIPAA, GDPR, or CCPA compliant.

Enterprise customers may request custom data agreements, ensuring additional control over data access and retention policies.

8. Limitation of Liability

Ethinova provides its platform "as-is" and explicitly disclaims all warranties, including but not limited to:

  • No guarantee of AI-generated code correctness
  • No responsibility for errors, bugs, or vulnerabilities in AI-generated code
  • No liability for business losses, downtime, or system failures arising from the use of Ethinova’s services
  • No responsibility for third-party integrations or dependencies

9. Changes to Terms

Ethinova reserves the right to update these Terms of Service at any time. Continued use of the platform after changes constitutes acceptance of the revised terms. Users will be notified of significant updates via email or in-platform notifications.

10. Termination of Services

Ethinova reserves the right to suspend or terminate user accounts for violations of these Terms, misuse of the platform, or non-compliance with licensing agreements. In cases of termination:

  • Users lose access to all AI-generated code stored on Ethinova
  • No refunds will be issued for any unused subscription periods
  • Any misuse leading to termination may result in legal action
